1. Publisher Information

The Virya mobile application (hereinafter "the Application") is published by:

2. Purpose and Acceptance of Terms

These Terms and Conditions (hereinafter "Terms") define the terms and conditions of use of the Virya Application, as well as the rights and obligations of the parties.

By using the Application, you agree to be bound by these Terms in full. If you do not accept these Terms, please do not use the Application.

3. Description of Service

Virya is a mobile nutritional coaching application powered by artificial intelligence that offers:

• Daily meal and nutritional intake tracking
• Automated AI-powered nutritional analysis
• Personalized meal suggestions
• Recipe creation and management
• Physical activity and hydration tracking
• AI conversational agent for nutritional guidance
• Integration with third-party health applications (Apple Health, Health Connect, Garmin, Fitbit)

3bis. Offers and Subscriptions

3bis.1 Free Offer

The Application offers a free tier including:

• Meal and macronutrient tracking
• 5 messages with the AI agent per day

3bis.2 Premium Offer

The Premium subscription unlocks all features:

• Unlimited AI messages
• Meal photo analysis
• Physical activity and step tracking
• Hydration tracking
• AI-powered personalized recipe generation
• Food barcode scanning
• Proactive AI suggestions

3bis.3 Subscription Plans

Virya Premium is available as:

• Monthly subscription: automatically renewed each month
• Annual subscription: automatically renewed each year
• Lifetime purchase: one-time payment, permanent access (promotional offer, limited availability)

3bis.4 Automatic Renewal

Monthly and annual subscriptions automatically renew at the end of each period, unless cancelled at least 24 hours before the end of the current period.

The renewal amount will be charged to your account within 24 hours before the end of the current period, at the current rate.

3bis.5 Pricing

Prices are displayed in your local currency at the time of purchase in the App Store or Google Play Store. Prices may be modified. In case of modification, you will be notified before the next renewal.

3bis.6 Payment

Payments are processed by Apple (App Store) or Google (Google Play), not directly by Virya. Virya does not collect or store your credit card information.

3bis.7 Cancellation

You can cancel your subscription at any time:

• On iOS: Settings > [your name] > Subscriptions > Virya > Cancel
• On Android: Google Play Store > Subscriptions > Virya > Cancel

Cancellation takes effect at the end of the current period. You retain Premium access until that date. No pro-rata refund is provided for the remaining period.

3bis.8 Refunds

Refunds are managed by Apple or Google, in accordance with their respective policies. To request a refund, contact Apple or Google support.

3bis.9 Free Trial Period

• Monthly and annual subscriptions include a 14-day free trial period.
• During the trial period, you have full access to all Premium features.
• The trial period begins upon subscribing and requires a valid payment method.
• Unless cancelled at least 24 hours before the end of the trial period, your subscription will automatically convert to a paid subscription.
• You can cancel at any time during the trial period without being charged.
• The free trial period is only available once per Apple ID or Google Play account.

3bis.10 Restore Purchases

You can restore your purchases at any time from the Application Settings.

4. Access and Registration

4.1 Access Requirements

The Application is accessible to anyone with a compatible mobile device (iOS or Android).

For minor users (under 18 years old), use of the Application is subject to prior authorization from a parent or legal guardian who accepts these Terms on their behalf.

4.2 Account Creation

Use of the Application requires creating a user account. You can register via:

• An email address and password
• Your Google account
• Your Apple account
• Your Facebook account

You agree to provide accurate and up-to-date information and to maintain the confidentiality of your login credentials.

5. Important Medical Disclaimer

The information and suggestions provided by the Application, including those generated by artificial intelligence, are for informational purposes only and do not constitute:

• A medical diagnosis
• Medical treatment
• A dietary prescription
• A substitute for medical consultation

You must consult a qualified healthcare professional (doctor, dietitian, nutritionist) before:

• Making significant changes to your diet
• Starting a diet program
• Making health-related decisions

The Application should not be used to treat, diagnose, or prevent any disease or eating disorder.

If you have a health problem, contact a healthcare professional immediately.

6. Personal Data and Privacy Protection

7. Artificial Intelligence

7.1 Operation

The Application uses artificial intelligence technologies to:

• Analyze meals and estimate nutritional values
• Provide personalized suggestions
• Answer your questions via the conversational agent

7.2 Limitations

Artificial intelligence can make errors. Nutritional estimates and suggestions provided are approximate and do not guarantee perfect accuracy.

We encourage you to verify important information and not rely exclusively on AI-generated results.

8. Intellectual Property

All elements of the Application (design, logos, texts, features, source code) are the exclusive property of Virya SAS or its partners and are protected by intellectual property laws.

Any unauthorized reproduction, representation, modification, or exploitation is strictly prohibited.

9. Liability

9.1 Limitation of Liability

Virya SAS strives to provide a quality service but cannot guarantee:

• The absence of interruption or error in the Application
• The accuracy of nutritional information provided
• The suitability of advice for your personal situation

Virya SAS disclaims all liability for:

• Direct or indirect damages resulting from use of the Application
• Decisions made based on information provided by the Application
• Health problems related to dietary changes

9.2 User Obligations

You agree to:

• Use the Application responsibly and legally
• Not attempt to compromise the security of the Application
• Provide accurate information
• Consult a healthcare professional for any medical questions

10. Termination

10.1 By the User

You may delete your account at any time from the Application settings or by contacting us at contact@virya.coach.

10.2 By Virya SAS

We reserve the right to suspend or delete your account in case of:

• Violation of these Terms
• Fraudulent or abusive use of the Application
• Behavior harmful to other users or the service

11. Modifications to Terms

Virya SAS reserves the right to modify these Terms at any time. Modifications will take effect upon publication in the Application.

In case of substantial modification, you will be notified by notification or email. Continued use of the Application after modification constitutes acceptance of the new Terms.

12. Governing Law and Jurisdiction

These Terms are governed by French law.

In case of dispute, an amicable solution will be sought first. Failing that, French courts shall have exclusive jurisdiction.

14. Miscellaneous Provisions

• If any provision of these Terms is declared void, the other provisions remain in force.
• Failure to exercise a right provided by the Terms does not constitute a waiver of that right.
• These Terms constitute the entire agreement between you and Virya SAS regarding the use of the Application.
